Éamon de Valera stated that he would serve as an ordinary IRA volunteer, and left the leadership of the Anti-Treaty Republicans to military leaders such as Liam Lynch.
Thousands of Anti -Treaty IRA members (including De Valera) were arrested by the Free State forces in the weeks after the end of the war, when they had dumped their arms and returned home.
However, although de Valera was in the area at the time, he is not known to have been involved in the assassination.

Following de Valera's resignation, Arthur Griffith was elected to his office, but though he preferred to use the earlier title of President of Dáil Éireann he never actually reverted the constitutional amendments of August 1921.
Meanwhile Michael Collins became Chairman of the Provisional Government of the provisional state created in the Anglo-Irish Treaty, 1921.
