For example, under section 1782 it may be possible to obtain a pretrial deposition in the United States in connection with an English lawsuit, notwithstanding that such depositions are not permitted under English law with respect to witnesses in England.
Thus, it remains uncertain whether Section 1782 can be used to obtain evidence from parties, or whether discovery of evidence from party opponents should be governed entirely by the rules of the jurisdiction in which the dispute is pending.
