Wisconsin Aviation, of course, takes issue with the court's findings regarding the excessiveness of its repair estimate, but more to the point, argues that the accuracy of the estimate is irrelevant to the issue of whether it is entitled to be paid for the services performed at Berryman's request.
Wisconsin Aviation maintains that its estimate was merely a "recommendation" of work it believed needed to be done in order for the plane to safely return to the air, which Berryman was free to reject, as ultimately he did.
Wisconsin Aviation's counsel relied on that document in his arguments, and, in a brief in support of Wisconsin Aviation's motion for reconsideration, counsel seems to concede that only $561.68 was established as due.

The damages that Western Aviation claims it incurred due to its inability to sell and lease airplanes were not the foreseeable result of a breach because they were due to special circumstances of which GSA was not aware at the time of contracting.
Stilwell testified that Western Aviation hires Marsh Aviation to perform work for it, but that testimony was a general description of the relationship between the two companies and did not relate either to the five airplanes at issue here or to the tow truck and tow bar.

Of the major risk factors associated with general aviation accidents, total number of flying hours and total number of flying hours in the type of aircraft that crashed were of striking importance.
Of 3805 aviation accidents, 1332 (35.0%) occurred in the first 500 hours of total flight time of the pilot and 348 (9.2%) occurred during the first 100 hours of flight time.
Aviation accidents are not distributed randomly and unpredictably; they are associated with identifiable risk factors that hold the key and promise of successful intervention and prevention.

This is a result of decisions in which various courts have held that the liability for aviation noise damages rests solely on the hundreds of individual airport proprietors, while responsibility for aviation noise abatement resides collectively among federal, state and local governments, air carriers, and airport proprietors.
While the 1958 Act seemingly granted the FAA responsibility for all aspects of aviation, it did not specifically authorize the FAA to establish limits on aircraft noise emissions or otherwise to regulate for noise abatement purposes.
However, effective February 1, 1981, the compliance dates were extended for some types of aircraft to January 1, 1988, [24] and Part 36 was made applicable to foreign as well as domestic aircraft.

In December 1958, all of the navigation, communications, and gunnery cadets were transferred to form the new 16th Aviation.School, and the 2nd Aviation School became responsible solely for training bomber and helicopter pilots (some bomber graduates also went to transport units).
Aviation theory increasingly became an important part of the curriculum.

Federal Aviation Regulation, FARS Section 23.971 Fuel tank sump, part b states, "(b) Each fuel tank must allow drainage of any hazardous quantity of water from any part of the tank to its sump with the airplane in the normal ground attitude.
The tank's original design (year 1981) included a single sump located in the aft corner near where the screen is located-item 25 in the figure.
This inspection was performed by the FAA in response to the letter dated April 19, 1999 addressed to Greg Roberts at the Nashville Flight Standards District Office to which this summary is attached.
