Kaplan's assertions put Shure on notice that he is claiming to be in privity of contract with RBK--the fact that he did not say this outright is of little consequence.
In his brief, Kaplan admits that "[t]he effect of the District Court's ruling of July 17, 1996 was to put Kaplan on notice that Weinberg and KR&W had committed malpractice against Kaplan by their failure to assign RBK's rights in the Contract to the Trust or to Kaplan in 1987." See Appellant's Brief at 20.
As a general proposition, therefore, Kaplan's assertion that the discovery rule does not apply in determining whether a statute of repose applies to bar a cause of action appears to be true--the time the action accrued is immaterial to the application of a statute of repose.

Classical Classics - Mahler's "Resurrection" Symphony, Classical Notes, Peter Gutmann
A final 1987 New York Philharmonic concert (DG 423 395) seethes with transcendent vision; while it's a bit diffuse and even stodgy at first, the finale builds from a choral entrance awash in hushed timeless mysticism to an apocalyptic ending of overwhelming intensity.
The Kaplan recordings really are impressive – their clarity fosters appreciation for the scope of Mahler’s wildly imaginative use of orchestral resources.
Kaplan has refashioned his life into one of utter service to Mahler; rather than isolating himself with the remove of academia, he puts himself on the front line through his performances.

Lincoln Portrait - The Earliest Known Daguerreotype of Abraham Lincoln
In 1977 Albert Kaplan purchased the daguerreotype receipted as "Portrait of a Young Man" from an art gallery in New York.
Kaplan believed that the best qualified people to analyze the image, and the assembled materials, to consider whether the daguerreotype is of Abraham Lincoln, would be plastic and reconstructive surgeons who work with the human face.
Because the trauma-induced deformations of Lincoln's face, distinctly described by Dr. Kempf, are seen unmistakably in the Kaplan daguerreotype, providing in themselves compelling evidence in support of the daguerreotype's authenticity, we reprint the Kempf analysis (from the title page to the end of Chapter I of Volume I).

Among other things, the Marshall Plan was also a reaction to this problem of deficient German deliveries to Europe.
Diplomatic historians have long argued that German reconstruction under U.S. political aegis was the core of the Marshall Plan (see particularly Gimbel (1976) and Hogan (1987)).
Given continued U.S. military presence in Europe, self-sustained recovery and economic cooperation could be implemented, such that U.S. deliveries to Western Europe were substituted with German exports.

This would be amazing were Kaplan a professional musician, but he is not, nor has he conducted anything else by Mahler with the single exception of the “Adagietto” from Symphony No.5, released in 1992—nor music by any other composer, for that matter.
As for Kaplan, before considering this newest version, Google revealed that he was born March 3, 1941, and founded Institutional Investor in 1965 after studies at Duke University, the New School for Social Research and the NYU School of Law.
In his own program note, Kaplan advises not to expect major changes, although many details will register with those who know the music from previous editions—the most recent before his was published in 1970, with some but hardly all the material Kaplan and his co-editor, Renata Stark-Voit tracked throughout Europe, culminating in New York.

 Intentionality
To use David Kaplan's (1979, 387) revealing word, a concrete individual is “trapped” within a singular proposition.
If, as Jerry Fodor (1975, 1987) has argued, there exists a “language of thought” consisting of mental symbols with syntactic and semantic properties, then possibly the semantic properties of mental symbols are the primary bearers of ‘original’ intentionality.
As a consequence of their denial of the reality of beliefs and desires, the eliminative materialists must face the challenge raised by the existence of physical objects whose existence depends on the intentions, beliefs and desires of their designers, i.e., human artifacts.

In Relevance lost, Johnson and Kaplan (1987) attributed the post World War 2 decline of American enterprise competitiveness and performance, to the use of inappropriate planning, control and decision making mechanisms, for the growing number of information and capital intensive industries.
The failure of management accounting practices to adapt quickly to the needs of the "new" enterprise could be attributed to two primary reasons (Johnson and Kaplan, 1987; Johnson, 1994).
These include activity based costing and management (Cooper and Kaplan, 1991; Cooper et al, 1992); the balanced scorecard, (Kaplan and Norton, 1992); quality (Deming, 1986; Oakland,1989; Hill 1991a; 1991b; Petty, 1997), and benchmarking (Balm, 1992; Bogan and English, 1994).
