In its response of September 22, 2000, TELUS argued that its allegation that the Department had violated the provisions of Article C.4.2 of the RFP by failing to advise it that its bid was non-compliant during the evaluation of its proposal was not a new issue.
BCE submitted that the said article contained two mandatory requirements: a mathematical formula and a requirement that the cost of adding SDAs not be higher than the total bid cost for five years.
BCE submitted that whether or not TELUS erroneously assumed, given the phase of the evaluation process, that its proposal was compliant does not excuse it from taking care in providing a correct response to the Department's request for clarification.

When the Canadian Radio-television and Telecommunications Commission, or CRTC, approved BCE Inc.'s purchase of CTV yesterday, Rogers stood by its assertion that this would open the door for it to claim ownership of Sportsnet.
The CRTC contends that allowing BCE, which counts Bell ExpressVu satellite systems among its many assets, to own CTV and its specialty channels (TSN, Discover, The Comedy Network) is a different matter because satellites operate digitally.
"Nothing they did with BCE is inconsistent with what they've done in the past," said Ian Morrison, spokesperson for the non-profit lobby group Friends of Canadian Broadcasting, which opposes cable ownership of channels.
