Information may be given to government officials investigating ADA compliance to state workers’ compensation offices, state second injury funds or workers’ compensation insurance carriers, and may be used for insurance purposes.
In addition to proving the existence of a “disability” within the meaning of the ADA, an individual claiming employment discrimination generally must also show that he is “qualified” for the employment position that is held or sought 42 U.S.C. § 12112(a).
Employers are free under the ADA both to establish and to alter the essential functions of a particular position; the statute does not interfere with the ability of employers to exercise business judgment with regard to job requirements.
