 | | While we believe the language of the bill is salvageable, we fear that in its present form, S. 630 would result in giving a cloak of legitimacy and legality to a practice that, at its core, is founded upon theft, trespass and the invasion of consumers' privacy. |
 | | Nevertheless, we wish to call to your attention the following problems with S. First, S. 630 is pure "opt-out," meaning that spammers are free to send as much UCE as they wish, with token requirements of truthfulness, leaving inundated consumers with the sole recourse of asking each new advertiser to refrain from future mailings. |
 | | As a threshold matter, S. 630 must also include a private right of action for consumers and the penalties should be increased to at least $500 per violating UCE. |
