Congress, on December 8, 1941, by joint resolution, declared a state of war to be existing between the Imperial Government of Japan and the Government and people of the United States.
The power of Congress, however, during time of war over aliens of a country which is hostile to the United States is almost plenary, (Footnote 50) as is that of the President by a series of acts dating to the foundation of the Union.
Since Congress provided for the punishment of persons violating the proclamations of the commanding officers, and since Yasui is an alien who committed a violation of this act, which included by reference the regulations of the commander referring to aliens, the court finds him guilty.

The intent of the bill was to restrict commercial fishing licenses to citizens of the United States, and aliens who had declared their intention to become citizens, wording which would have effectively removed Japanese from the commercial fishery without ever specifically mentioning them by name.
In addition, it was suggested that the Department of State might hold serious reservations since AB 336 appeared to violate the spirit, if not the letter of the Treaty of Commerce and Navigation which commercially linked the United States and Japan.
The legislation contemplates the restriction of all commercial fishing under the jurisdiction of the State of California to citizens of the United States and had been endorsed by the American Legion, Veterans of Foreign Wars, and other groups as a safeguard to prevent further espionage on fleet activities and operations.

He was commissioned Colonel, United States Army, and aide-de-camp to General Charles Cotesworth Pinckney in 1799 and was a volunteer in the defense of Washington, D.C. during the War of 1812.
