ABKCO points out that even if this is so, and even assuming that § 303(b) "clarified" that the Second Circuit' s construction in Rosette was correct, the effect was to change the law in the Ninth Circuit.
ABKCO argues that dismissal of Delta Haze' s counterclaim was proper because it never threatened to sue for infringement, therefore there was no controversy between them to give the district court subject matter jurisdiction.

ABKCO Records is a record company owned by music impresario Allen Klein.
ABKCO stands for "Allen B. Klein Company", but was sometimes jokingly referred to by Allen Klein as "A Better Kind of COmpany".
When he was demoing this song for Phil Spector during 1970 he jokingly changed one line of the lyrics to "Beware of ABKCO", propably referring to the economical disaster the Beatles went through because of Allen Kleins mismanagement.

ABKCO's 22 Rolling Stones hybrid SACDs set a very high standard for reissues, sonically and otherwise, when the catalog was released in 2003.
ABKCO smartly avoided confusing consumers by not pushing the SACD layer on the packaging and by not charging a premium.
Sealing the format's fate for ABKCO, was Sony's recent decision to reduce hybrid SACD replication at its Terre-Haute Indiana plant (launched with much fanfare May, 2003) to one day a week.

ABKCO Records Announces Surround Sound SACDs from the Animals & Herman's Hermits - SH Forums
Since their success with the Rolling Stones Remastered Series, ABKCO Records officials indicate that they planned to continue to remaster and reissue the balance of their key catalog albums in Hybrid SACD format.
At HE 2004, ABKCO made good on that promise by announcing plans to release "Greatest Hits" albums by both the Animals and Herman's Hermits as 5.1 Hybrid Surround Sound SACDs due out in mid summer.
The announcement of the Animals and Herman's Hermits titles was a bit of a surprise since most of the buzz in the industry has been on rumors of ABKCO's remastering of some of their Cameo/Parkway catalog titles for release on Hybrid SACD discs.

The following day his ABKCO Industries was officially appointed business manager of the Beatles companies, but Paul refuses to sign contract, opposed to Klein's appointment.

 ABKCO Music v. Harrisongs Music
Consequently, the district <221 USPQ 494> judge directed that ABKCO hold the “fruits of its acquisition” from Bright Tunes in trust for Harrison Interests, to be transferred to Harrison Interests by ABKCO upon payment by Harrison Interests of $587,000 plus interest from the date of acquisition.
First, it is argued that ABKCO did not breach its fiduciary duty to Harrison because (a) no confidential information was improperly passed from ABKCO to Bright Tunes during the negotiations to purchase HSF, and (b) there was no causal relationship between ABKCO’s actions and Harrison Interests’ failure to obtain settlement.
ABKCO contends that the remedy thus jeopardizes the post-liability-trial settlements of the foreign infringement claims between ABKCO and Harrison Interests (through Essex).

ABKCO was discharged in March of 1973, triggering bitter litigation which was eventually settled for $4.2 million.
ABKCO paid $422,500.00 to Bright Tunes and an additional $165,000.00 to the composer's heir; the latter sum was paid partly in cash and partly to purchase a nine-year $15,000.00 annuity for heir's benefit.

Allen Klein's Abkco Records was for many years the label collectors loved to hate.
Worse yet, Abkco, which controlled Sam Cooke's Tracey Records catalog, actually sued to get an RCA Cooke compilation off the market, because it included one track ("Another Saturday Night") which they said belonged to them.
Retrospective is also the title of the Animals disc (Abkco 9325-2), with twenty-two tracks, more than half of which Klein didn't own and actually paid to license.

Because both "Brown Sugar" and "Wild Horses" were recorded in 1969 while they were technically still under contract to Decca, Abkco got the rights to include both songs on the first "Hot Rocks" compilation.
