In version 2.0 of the APSL, the definition of “Externally Deployed” has been narrowed in a way that is appropriate for the respect of users' freedoms.
The APSL 2.0, like the Affero GPL, seeks to defend the freedom of those who use software in these novel ways, without unduly hindering the users' privacy nor freedom to use the software.
Even though the fatal flaws of the APSL were fixed, and even if the practical problems were addressed, that does no good for the other parts of Mac OS X whose source code is not being released at all.

APSL 1.2 addresses the first two concerns by removing the restrictions put in place by the previous version.
Anyone modifying code issued under APSL 1.2 now needs only include the relevant licence agreement with their changes and acknowledge Apple's copyrights - the source code need only be published if it's distributed externally.
As he rightly points out here, APSL isn't a true free software licence, since it "allows linking with other files which may be entirely proprietary" and is "unfair, since it requires you to give Apple rights to your changes which Apple will not give you for its code".

This within the, other 20 than looking at that document, which doesn't discuss what 21 their plans were for transfer fees, and he admitted he 22 didn't see one thing or the other, he gaifs his views as to 23 whether or not the APSL would pay money for transfer fees or 24 not.

Section 9.1 of the APSL allows Apple to terminate our rights to use any or all APSL-covered code, at its sole discretion, in the event of an unproven claim of infringement, no matter how specious.
This is derived from a similar objectionable portion of IBM's Jikes license, which disqualified that license from being referred to as "Open Source".

A new version of the Apple Public Source License (APSL) 1.2, released on Wednesday, addresses and alters all of the primary issues that many developers had problems with; many programmers felt that the original APSL was heavily weighted towards Apple's benefit.
Earlier versions of the APSL did not allow developers to modify code for their personal use -- any and all changes had to be publicly distributed.
Under the terms of the new APSL, developers no longer need to distribute modifications made for personal use, are no longer required to notify Apple when code modifications are released, and the Infringement/Suspension clause has been removed; developers are now responsible for securing all necessary rights themselves.

Interesting that there was supposed to be a team in Chicago in the APSL in 1990.
The APSL Rowdies were, for all intents and purposes, the "original" NASL Rowdies.
They were not yet in the APSL, as it debuted in 1990.

I was working with Bill Sage and 12 Bob Healy from the APSL to come up with a plan that would 13 work for somebody, presumably at that point APSL, in the 14 United States Soccer Federation to have a professional 15 Division I league.
It was the result of discussions that I had 14 with the APSL at the time, that they couldn't just think 15 that they could automatically bootstrap themselves into 16 Division I status.
This was on the table clear as could be between 23 myself and the then members of the APSL of which 24 Mr.

Densmore may have misinterpreted a main difference between the APSL and the GPL concerning larger works: those derived from sources of either said licenses and other licenses, including private source.
Unlike the GPL, the APSL allows its source to be part of larger works without requiring all other source of the larger works to inherit the APSL license.
The sole requirement here is that any modifications to the APSL licensed sources used must be publicly available.

The problems arose when the APSL or the AP would incorrectly record the victory in the shootout as a 3-2 victory and add 3 goals to the winning team's total when it should have had only 2, because shootout "goals" are not "real" goals.
In 1994 we had an APSL Championship game between only the 3rd and 4th best teams in the league, and not the top two.
Under the present APSL system, one strategy for a team would be to rest the best players in the away leg, don't care if they lose 10-0, and hope they win the home leg 1-0 with their rested players who would still be fresh enough to help their team win the "Mini Game".

The APSL does not infect other projects the way the GPL does.
It does not care what the other code is. For proof of this I present OS X. Its core, Darwin, is APSL yet it runs the Aqua interface on top of it which is closed source and completely dependant on Darwin. The APSL is not more restrictive than the BSD or MIT licenses.
The only significant difference is that the APSL specifically states that Apple, or Raphael in our case, has the right to use any modifications you make and distribute and to do so in accordance with the APSL.

Also, some say that the code released is actually a system which is sufficient for certain uses (though not including the graphical convenience that is the Macintosh's main technical feature).
If so, I stand corrected; perhaps the code Apple has released would make some nontrivial contribution to the free software community, if the current APSL were replaced with a free software license.

Version 2.0 of the APSL is now considered a Free Software license by the Free Software Foundation, who is best known for the GNU Project and the GNU General Public License.
Apple used the KHTML rendering engine from the Konqueror project as a basis for its Safari web browser, but instead of taking the code and running (as a certain other company might have done), Apple contributed its changes back to the Konqueror folks, helping them out in the process.
The changes in the APSL reinforce the belief that Apple genuinely believes that open source is a Good Thing™, and that in itself is a Good Thing™.

He was very intent on representing Apple as having 'stolen' code, and having misrepresented itself, because of various nits with the APSL.
I am grateful that he did the research to show that the OSI was doing a poor job of representing the community, but he doesn't quite get the part where people disagreed with the OSI's decisions.
He also claims that Apple was acting in bad faith about the APSL, despite the fact that Apple kept on revising the APSL for even the slightest criticism (people might recall that Bruce Perens and Eric Raymond took turns approving the APSL, and not approving the APSL) seems to go unnoticed.

I'm afraid that an APSL license would cause the source to stagnate except for the eyes of a few Wizards that learn from the implimentation and then develop their own (L)GPLed version.
The APSL is on the OSI approved license list [slashdot.org] meaning it fits the DFSG and APSL code could be included in Debian's main codebase, no problem.
Incidentally, Debian does maintain [debian.org] a non-free portion to their distribution, it is just that this portion is not considered "part of the main distribution", and it is not always included with the install discs (it depends on how you obtain your copy of debian, as far as i can tell).

The Free Software Foundation while approving The Apple Public Source License as a free software license also deprecate it's use being it not compatible with the GNU General Public License and being not a copyleft license because it allows linking with files released intirely as proprietary software.

The Darwin team at Apple has released version 2.0 of the Apple Public Source License, which includes numerous changes to "make it even easier for Open Source developers to use and comply with, has been certified as conforming to the definition of a "Free Software License".
Users can also use a new or existing "Apple ID" to access the source code under the terms of APSL 2.0, rather than needing a separate Darwin account.
