The first environmental lawsuit was brought against Asarco in 1910 by a group of farmers in Solano County, California for the sulfur dioxide emissions from the company's San Francisco Bay smelter.
In the 1970s, the Centers for Disease Control found that the Asarco smelter in El Paso, Texas was responsible for abnormally high lead levels in children who lived nearby.
Asarco had more than 100 civil environmental cases pending against it when it filed for bankruptcy.

ASARCO, originally known as the American Smelting and Refining Company, traces its origins to 1881, when Robert Safford Towne arrived in El Paso after touring the mines in the Mexican state of Chihuahua.
During the 1920s ASARCO was the largest mining operator in Mexico, with twenty-four different units.
In 1948 slag fuming facilitators were built for the recovery of zinc from the slag produced by the lead furnaces, and in 1951 ASARCO built a 612-foot smokestack to reduce ground-level concentrations of sulfur dioxide.

Asarco's inability to provide financial assurance puts the company in violation of the consent decree it established with the EPA to cover the cleanup costs in East Helena, according to EPA officials.
Asarco has assured the EPA that once the company's "complex debt restructuring negotiations are complete, we will again be able to use the financial test to demonstrate assurance at East Helena," according to a letter from Douglas McAllister, Asarco's vice president, general counsel and secretary.
She also is seeking some kind of assurance that Asarco will pay for cleaning up the mess left from more than 100 years of mining and smelting in Montana, and is pressing the state, along with the EPA, to take some type of action.

Judge Joseph Howard, writing for the court, said the problem for the Amparanos and other potential plaintiffs is that one of the claims alleges that by emitting pollutants, Asarco trespassed on their land, damaged it by a public nuisance, was negligent in doing so and is strictly liable for the damages.
The court said that means that Asarco is entitled to have the case heard in the county where the land is located.
Asarco said that Shanker was an attorney from 1993 to 1995 at the firm of Fennemore Craig.
