HOLLYWOOD LAW CYBERCENTER - Studio Accounting Practices
Production costs are most commonly disputed over the accounting for direct costs, studio overhead charges, overbudget penalties, payments to gross participants, and interest.
What this means is that the production cost (and attendant overhead and interest charges) spiral ever upward as a film becomes more and more successful, ultimately adding millions of dollars to production costs.
In such cases, the net profit participant may be able to base a claim on the implied covenant of good faith and fair dealing, arguing that the studio has an obligation not to do anything that is likely to prevent the profit participant from receiving the anticipated benefits under their agreement.

First, I’m going to sue Aaron Spelling Productions, who produced the TV show “Melrose Place,” for making me stupid.
I used to watch “Melrose” religiously, completely unaware that by doing so I was shaving precious points off my I.Q. Aaron Spelling Productions should have warned me of the negative impact its program was having on my brain — and that omission, I’m afraid, is going to cost them one hundred million dollars.
As my reputation for being stupid has become widespread -- thanks to the handiwork of Aaron Spelling and the Gap -- I’ve tried to compensate by having an attractive, world-class bottom.
