Mikva, who is one of those unique individuals that has served in all three branches of the government as a state legislator, a congressman, a Judge on the federal circuit, and as White House Counsel, said that he initially thought of the Separation of Powers as a "fourth of July phrase.
Mikva opined that the Separation of Powers is an important part of our democracy because it is not like "three ships passing in the night, but because it like three ships that are with hailing distance of other, engaging each other" and that dialogue is essential.
Mikva explained, in response to a question, that staunch partisanship, which is at the root of some of the conflicts between the branches of government, is "bad for the country.

Mikva, 70, has had an extraordinary vantage point from which to forge his faith.
He is one of a small group in the nation's history to have served in high positions in all three branches of the federal government: as a Democratic member of Congress; as chief justice of the U.S. Court of Appeals for Washington, D.C.; and as chief counsel to the president.

That Judge Mikva considers a gross travesty of justice to be of lesser importance to the criminal justice system than overcrowding in prisons, suggests that he is either ignorant of the facts, indifferent to serious public outcry, or has been seduced by political expediency.
Mikva is ignorant of the facts of the Pollard Case, it would have been prudent for him to refrain from raising the subject and rendering judgment.
Mikva is not ignorant of the facts, then his attitude suggests an appalling indifference to the expressed concerns of millions of citizens worldwide.

Mikva grudgingly accepts that President Bush is president, though in a Washington Post editorial he emphasizes that Gore won the popular vote.
Mikva also argues that it would be unseemly to allow the President to add to a court that "itself made the final decision as to who should be president." Mikva again chooses to ignore that voters chose this president through our constitutional electoral system.
For years, conservatives criticized Mikva as one of the most liberal members of Congress and later as one of the nation¹s most liberal judges in D.C. Long accused of continuing his legislative career from the bench after leaving Congress, Mikva was once dismissed on the same basis.

Address to the American Bar Association Thurgood Marshall Awards Dinner Honoring Abner Mikva
When Abner concluded that her request to be heard should be honored, his two colleagues insisted on the presence of a nurse, fearing that she might suffer an attack (either from unworldly assailants or from heat stroke) while presenting her argument.
Abner's response was to move to Evanston, a wealthy and primarily Republican suburb, and to run for Congress from that District.

Mikva not Suited for White House Counsel Job
Newly-appointed White House Counsel Abner Mikva, currently a judge on the District of Columbia Court of Appeals, has compiled a track record which suggests that he may not be the right person to tell the President hard truths about the need for strict compliance with legal and ethical standards.
Mikva appears rather adept at side-stepping legal and ethical rules himself and getting away with it, a practice which has already caused too much self-inflicted damage for the Clinton Presidency.
Mikva's October 1979 appointment to the federal bench far preceded the January 1981 date he would become Constitutionally eligible for a judgeship.

"Dissenting Opinion," a profile of Abner Mikva, University of Chicago Magazine, August 1996
It was, in many ways, an unlikely match: Mikva would be representing a suburban district that, while having liberal pockets, was largely wealthy, conservative, and populated with business executives--yet his agenda was considered quite liberal.
The heavy lobbying forced some professed Mikva supporters, including Senator Bob Dole, to vote against him, but in the end he barely squeaked out of the Judiciary Committee and was confirmed on a 58-31 vote, a vote he is sure he'd lose today.
Mikva also points with considerable pride to an opinion that struck down a Defense Department regulation against gays serving in the military, even though his ruling was ultimately reversed.

Accordingly, if after having attended such a seminar a judge decides to advance an argument against the mainstream interventionist policy, this must mean the judge was paid to do so or did it to compensate the funders for the wonderful time he or she had at the seminar.
