During an international armed conflict, the laws of war permit the detention of captured enemy soldiers until the end of the war; it is not necessary to bring charges or hold trials.
The administration insists that the laws of war give it unfettered authority to hold combatants as long as the war continues—and the administration argues that the relevant “war” is that against terrorism, not the long since concluded international armed conflict in Afghanistan during which most of the Guantánamo detainees were picked up.
