Gowlings Resources [Objection! Objecting to a Bankrupt's Discharge]
It is for this reason that the discharge date is often overlooked or forgotten in the surprise of bankruptcy and the haste to file a proof of claim.
Discharges have been refused where the bankrupt has gone into bankruptcy three or more times, the bankrupt displayed a flagrant and callous disregard for the rights of creditors, or the bankrupt failed to co-operate with the trustee.
Discharges have been granted when the bankrupt was honest and sincere in his dealings and where the bankruptcy was caused by circumstances beyond the bankrupt's control and generally where there was no misconduct on the part of the bankrupt.

CATHOLIC ENCYCLOPEDIA: Moral Aspect of Bankruptcy
Some special debts and obligations are not affected by the discharge, and the question arises whether an absolute discharge extinguishes the debt, or merely releases the bankrupt from legal liability.
On the contrary, an absolute discharge, when granted to the honest bankrupt according to English law, frees the bankrupt from his debts, with certain exceptions, and makes him a clear man again.
When, therefore, an honest bankrupt has obtained his absolute discharge in an English court, he is under no strict obligation, legal or moral, to pay his past debt in full, though if he choose to do so, his scupulous rectitude will be much appreciated.

If a discharge occurs, under this section or pursuant to a finding of no probable cause by the court, the receiving facility shall, with the consent of the person admitted, return such person to the place where the person resided at the time the petition and physician's certificate were completed and signed.
Conditional discharge shall be appropriate when the person has recovered from his mental illness to such an extent that he no longer requires inpatient treatment but a prescribed regimen of medical, psychiatric, or psychological care or treatment is necessary to prevent the recurrence of the circumstances which led to the person's dangerous condition.
If a person's conditional discharge is absolutely revoked pursuant to this section, the person shall receive notice of the reasons for the absolute revocation and shall have a right to appeal as provided in RSA 135-C:52.

Instead, the Act now provides that all references to a discharge granted after July 24, 1992 must be removed from the "automated criminal conviction records retrieval system" (CPIC) one year after the grant of an absolute discharge and three years after the grant of a conditional discharge.
When I asked the National Parole Board why discharged offenders could no longer apply for a pardon I was told it was because they were not convicted of their offence and, therefore, did not have criminal records -- the same explanation falsely given by the Government to explain the discharge provisions 32 years ago.
Thus, even though records of discharged offences may be separated from the RCMP's retrievable files after a period of time, they may remain indefinitely available to law enforcement authorities in the US and other countries from their own databanks.
