The FIA technical delegate Jo Bauer examined the system and concluded that it was not in compliance with Article 11.1.3 of the 2004 FIA Formula 1 Technical Regulations and referred the question to the stewards of the meeting: Paul Gutjahr, Mumtaz Tahincioglu and Waltraud Wunsch.
The stewards ruled that the BAR system was not acceptable but BAR has now appealed that decision in order to get a clearer picture of why the system is not allowed because there are implications in other systems in other areas of the car.
It is perhaps worth noting that for several years the Honda Prelude SH model has been fitted as standard with a system called the Active Torque Transfer System on which it seems the BAR system is based.
