Topic: Acts of independent significance

  Linguistics
Contextual and independent -- Contextual linguistics is concerned with how language fits into the world: its social function, how it is acquired, how it is produced and perceived.
Independent linguistics considers languages for their own sake, aside from the externalities related to a language.
The independent significance of each of these areas is not universally acknowledged, however, and nearly all linguists would agree that the divisions overlap considerably.

In response, the insureds assert that causal connection is not severed because the acts of the wrongdoers are intentional criminal acts and that the intent of the wrongdoers is irrelevant to UM coverage.
If the evidence establishes that the acts of an uninsured motorist, which were related to the transportation nature of the motor vehicle, resulted in or contributed to the injury, then causal connection exists between the use of the vehicle by an uninsured motorist and the injury.
It is immaterial whether there was an act of "independent significance," or whether the perpetrators of the crime were considered "operators" of the vehicle.

For a given significance level, one way of deciding which decision rule is best is to pick the one that has the smallest chance of a Type II error when a given alternative hypothesis is true.
In regression, the independent variable is the one that is supposed to explain the other; the term is a synonym for "explanatory variable." Usually, one regresses the "dependent variable" on the "independent variable." There is not always a clear choice of the independent variable.
The Law of Averages says that the average of independent observations of random variables that have the same probability distribution is increasingly likely to be close to the expected value of the random variables as the number of observations grows.

Final Rule: Investment Company Governance; Rel. No. IC-26520, July 27, 2004
The amendments are designed to enhance the independence and effectiveness of fund boards and to improve their ability to protect the interests of the funds and fund shareholders they serve.
These rules rely on the independent judgment and scrutiny of directors, including independent directors, in overseeing activities that are beneficial to funds and fund shareholders but that involve inherent conflicts of interest between the funds and their managers.
We expect that the requirement that independent directors must meet at least once quarterly in separate sessions, without the presence of directors who are interested persons, likewise will improve fund performance by strengthening the role of independent directors and fostering better communications and greater cohesiveness among the independent directors.

Pour-over will - Wikipedia, the free encyclopedia
A pour-over will is a testamentary device wherein the writer of a will creates a trust, and decrees in the will that the property in his estate at the time of his death shall be placed in the trust.
Under the common law of England, such devices were long held to be void, because the testator could change the disposition of the trust at any time, and therefore could essentially execute changes to the will without meeting the formalities required for such acts.
More recently, however, many jurisdictions have adopted the view that a pour-over will is a legitimate device, and have given them effect.

Professor Francis A. Boyle Testimony - Restoration of Hawaiian Independence
And indeed the Palestinians have the requisite votes to be admitted to the United Nations organization as a sovereign independent nation state, and yet it is the threat of a United States veto that had prevented the admission of the state into the United Nations organization.
That's what it was, a clearly illegal act, an invasion in violation of treaties and international agreement, an invasion in violation of international law, and the United States Constitution, the overthrow of a lawful government.
So a state, an independent sovereign nation state is one way a people who are threatened with extermination by means of genocide can attempt to protect themselves.

 Mass Media in Ukraine
Since becoming independent, Ukraine has had to overcome vast difficulties: collapse of the economy and rampant inflation in the first few years of independence, threats to its geographic integrity, and internal disunity.
A constitution was needed, and, not least important, Ukraine as an independent nation needed to be created in the minds of its citizens and the world as a whole.
What followed was a veritable explosion of independent publications throughout the Soviet Union, many of which, however, soon realized that more was needed than enthusiasm to run a paper and soon collapsed again for lack of funds or readership (Pryliuk, 1993: 284).

Moreover, the modern trend is to permit the use of an apparent agency theory to hold a hospital liable for the negligence of a doctor/independent contractor where there has been a holding out of the doctor by the hospital and reasonable reliance thereon by the plaintiff.
Apparent authority thus must be determined by the acts of the principal rather than by the acts of the agent.
Although, until recently, hospitals were not held liable for the acts of independent-contractor physicians who practiced within the hospital emergency room, the courts in several states have held hospitals liable under certain circumstances for the negligence of these independent contractors.

ThisNation.com--Tinker v. Des Moines School District
The District Court concluded that the action of the school authorities was reasonable because it was based upon their fear of a disturbance from the wearing of the armbands.
In order for the State in the person of school officials to justify prohibition of a particular expression of opinion, it must be able to show that its action was caused by something more than a mere desire to avoid the discomfort and unpleasantness that always accompany an unpopular viewpoint.
In the present case, the District Court made no such finding, and our independent examination of the record fails to yield evidence that the school authorities had reason to anticipate that the wearing of the armbands would substantially interfere with the work of the school or impinge upon the rights of other students.

Local land use, environmental justice, and entertainment coverage is of course very important, but we have a duty as citizens of the world to educate ourselves about the bigger picture.
The Independent’s excellent articles addressing the moral and legal implications of this horrible situation do what newspapers are supposed to do: make us think.

When the President acts pursuant to an express or implied authorization of Congress, his authority is at its maximum, for it includes all that he possesses in his own right plus all that Congress can delegate.
A seizure executed by the President pursuant to an Act of Congress would be supported by the strongest of presumptions and the widest latitude of judicial interpretation, and the burden of persuasion would rest heavily upon any who might attack it.
When the President acts in absence of either a congressional grant or denial of authority, he can only rely upon his own independent powers, but there is a zone of twilight in which he and Congress may have concurrent authority, or in which its distribution is uncertain.

Under laws of certain states of the United States of America, a will cannot be used to disinherit a surviving spouse, who is entitled to at least a portion of the testator's estate.
A testator may also be able to revoke by the physical act of another (as would be necessary if he is physically incapacitated), if this is done in his presence and in the presence of witnesses.
Some jurisdictions may presume that a will has been destroyed if it was last seen in the possession of the testator but is found mutilated or cannot be found after his death.

The significance of this is that Abraham Lincoln is one of the seminal figures in American history, and a popular publication like this can make a mockery of him and issues, and it doesn’t really affect the legacy and the ideas and the controversy that surrounds him.
And that meant that after Missouri was admitted to the Union in 1820 or ’21, that Congress resolved that in all the remaining territory north of 36&Mac251;30’—which was a southern boundary of Missouri—all the remaining territory would be forever free.
They declared independence and union together, and there was never any time in which any state acted on the international sphere, having diplomatic relations—and the Constitution itself forbids each state to have any diplomatic action.

Unclaimed Territory - by Glenn Greenwald: The significance of Hamdan v. Rumsfeld
Having said that, I agree with Marty that the real significance of this decision is not its effects on military commissions themselves, but the broad legal principles the decision affirms.
Should any doubt arise as to whether persons, having committed a belligerent act and having fallen into the hands of the enemy, belong to any of the categories enumerated in Article 4, such persons shall enjoy the protection of the present Convention until such time as their status has been determined by a competent tribunal.
However, the majority then engages in some significant contortions to hold that the prior common law history of trying various defendants for conspiracy starting in the Civil War and then going through WWII somehow does not establish a crime of conspiracy which can be used against Hamdan.

 Manhattan Hearing Transcript - March 15, 2002
Cromartie clearly indicates that if a jurisdiction draws district lines to fulfill partisan political objectives, the fact that a large number of residences of the district are also members of a racial minority group does in and of itself render the district a racial gerrymander.
Because Section 2 of the Voting Rights Act protects voters from any election procedures that deprive them of an effective vote because of their race, color or membership in a language minority group, states and local jurisdictions are legally required to avoid diluting minority voting strength during redistricting.
The Supreme Court and several district courts have endorsed the principle that jurisdictions have a compelling interest in complying with the Voting Rights Act during redistricting and that complying with the Act is a defense against constitutional attack.

The three people who passed the Federal Reserve Act in 1913, knew exactly what they were doing when they set up this private bank, modelled on the Bank of England and the fact that THE BANK OF ENGLAND had been operating independently unopposed since 1694 must have given them a great deal of confidence indeed.
