Topic: Administration of Justice Act

Judicial system of Denmark - Wikipedia, the free encyclopedia
In addition to their normal duties, county court judges act as notary public and bailiffs, as well as administrators of bankruptcy proceedings and probate matters.
In regards to the administrative tasks, these functions may be assigned to an assessor, which is a deputy judge.
As a result the responsibility of administering the justice system and courts was removed from the Ministry of Justice and given to a newly formed, independent Court Administration, thereby securing separation of the judicial and executive branches of government.

In that case, the Court of Appeal ruled that section 36 of the Administration of Justice Act, 1970, had no application to the situation where a mortgagee took possession without seeking a court order; and a court order for possession is not necessary unless the mortgage terms expressly or by implication require it.
The broader powers of the court in such cases, as compared to the Administration of Justice Acts, enable it to consider a number of factors in determining the outcome; this is more likely to lead to a decision favourable to the tenant.
Under the jurisdiction to postpone possession claimed by the courts prior to the 1970 Act, the court was necessarily interfering with the terms of the mortgage contract by permitting any postponement of possession at all.
