 | | The contents of an issued advisory opinion include a description of the material facts known to OIG/HCFA regarding the arrangement for which an advisory opinion was sought, and a statement of the agency`s opinion regarding the subject matter of the request based on the facts provided and known to the agency. |
 | | As set forth in the agencies` advisory opinion regulations, any advice given by OIG or HCFA is without prejudice to the right of the agency to reconsider the questions involved and, where the public interest requires, to rescind or revoke the action at a later date. |
 | | Third parties are not permitted to rely on an advisory opinion, and they may not introduce an advisory opinion issued to another individual or entity as evidence to prove that they (the third party) did not intend to violate the provisions of the fraud and abuse or self-referral laws implicated by such opinion. |
