Aetna removed the case to federal court pursuant to 28 U.S.C. The jury ruled for Ace on her bad faith claim and awarded her $27,009 for the wrongful denial of disability benefits and $100,000 for emotional distress.
Aetna representatives advised her that although her policy required her to be "under the care of a physician," the physician need not be a specialist.
Aetna appeals the denial of a new trial on the award of "emotional distress" damages, asserting that the district court erred by failing to instruct the jury that a plaintiff seeking emotional distress damages must prove that her distress was "severe" before any damages may be awarded.

On August 18th at 23:41, Aetna, along with Medic 2, was alerted for an MVC involving a motorcycle at the intersection of E.Chestnut Hill Rd and Old Chestnut Hill Rd. First arriving units found a destroyed motorcycle laying in the roadway with the injured operator laying on the shoulder.
On August 12th at 23:09, Aetna, along with Medic 3, was dispatched for an MVC with a vehicle overturned and on fire at the intersection of North Chapel St and New St. Engine 9-5 was first on scene at 23:13, finding a single vehicle on its' roof and on fire.
On June 30th at 19:49 hours Aetna along with Medic 3 and Trooper 4 were dispatched to an MVC with entrapment in the 700 block of Paper Mill Rd. NCC EMS 1 was first on scene at 19:53 hours reporting a total of 2 patients with one trapped.

Aetna is seen as eager to split off either its Aetna Financial Services unit or Aetna International, which would give the company a major cash infusion to channel into its health-care operation, which accounts for about 80 percent of the company's total revenue.
One problem for Aetna is that if the ING overtures don't work out and the company ultimately sells its units piecemeal, the company could face some big tax penalties associated with those types of sales, said Greg Crawford, an analyst at Fox-Pitt Kelton Inc. He has an "attractive" rating on Aetna stock.
