Appropriate measures, provided that they are consistent with the provisions of this Agreement, may be needed to prevent the abuse of intellectual property rights by right holders or the resort to practices which unreasonably restrain trade or adversely affect the international transfer of technology.
In the case of intellectual property rights for which protection is conditional upon registration, applications for protection which are pending on the date of application of this Agreement for the Member in question shall be permitted to be amended to claim any enhanced protection provided under the provisions of this Agreement.

Thus, national legislation clearly defining trade relief available to private parties, and the procedures for obtaining that relief and coordinating it with the WTO system, is clearly consistent with the development of a strong democratic system and is likely to lead to more effective enforcement of WTO rights.
