Air Force Academy inquiry finds religious insensitivity | The San Diego Union-Tribune
WASHINGTON – An Air Force task force sent to investigate the religious climate at the Air Force Academy in Colorado Springs found evidence that officers and faculty periodically used their positions to promote their Christian beliefs and failed to accommodate the religious needs of non-Christian cadets.
The task force was appointed May 2 by the acting secretary of the Air Force, Michael L. Dominguez, after more than a year of complaints about religious coercion at the academy.
An academy chaplain, Capt. MeLinda Morton, went public in May with accusations that the religious problem at the academy was "pervasive." She had been part of a team at the academy asked to design a program to promote religious tolerance.

CNN.com - Air Force probes religious bias charges at academy - May 5, 2005
Among the allegations are that cadets are frequently pressured to attend chapel and take religious instruction, particularly in the evangelical Christian faith; that prayer is a part of mandatory events at the academy; and that in at least one case a teacher ordered students to pray before beginning their final examination.
"When the Air Force is denied the service of the country's best and brightest young people because they feel excluded from the academy by religious intolerance, the armed forces and the nation as a whole are weakened," the report said.
The task force is expected to examine academy commanders who may "enhance or detract from a climate that respects both the free exercise of religion and the establishment clauses of the First Amendment," according to an Air Force statement.

Air Force Times - News - More News.
DENVER — The Air Force released new guidelines for religious tolerance Monday that discourage public prayer at official functions and urge commanders to be “sensitive” about personal expressions of religious faith.
The guidelines, which apply to the entire Air Force, were drawn up after allegations that evangelical Christians wield so much influence at the Air Force Academy in Colorado Springs that anti-Semitism and other forms of religious harassment have become pervasive.
An Air Force task force concluded that some students and staff at the school have the perception that the academy favors evangelical Christians and is intolerant of those who do not share their faith.

In Air Force Academy, Judge Sternburg found, as relevant here, that the Respondent did not violate the Statute when it issued the discourteous conduct memorandum to Parmelee because the memorandum was based on remarks Parmelee made while he was performing his job, not while he was engaged in protected activity.
The allegations included in the remand were that the Academy had restricted employee Michael Parmelee's use of official time and his access to telephones, and had issued a memorandum alleging that he had engaged in discourteous conduct, because he was engaged in union representational activities.
Based on the Academy's response, and on further reflection, I conclude that action affecting an employee's conditions of employment should be deemed to have been taken "against" him without respect to the agency's intent.

Finally, the General Counsel argues that the Respondent's reliance on AFI 38-203 should be rejected as the Air Force Regulation does not have the full "force and effect of law" and therefore does not prohibit the release of the TPP to the Union.
The Respondent argues the Air Force Instruction 38-203 implements OMB Circular A-76 and that it has a set of provisions that specifically protects certain information from disclosure during and after the appeals process, and the TPP is specifically protected from disclosure.
Respondent appears to argue that AFI 32-308 must have the "force and effect of law" because it is a mandatory Air Force regulation.
