Thus the first khums was not given from the spoils of war, but from a buried treasure (which is one of the seven items eligible for khums).
It is apparent, that the Khums is NOT restricted to a booty from a war, as the Sunnis claim; rather, it extends to all of the above issues.

The Khums is a worship in which the Niyyah is for seeking the pleasure of Allah, by intending or saying: "I give this amount as Khums Qurbatan ilallahi Ta'ala".
To determine the Khums one has to assign a certain day in the year called "the commencement of the year", such as the first day of the Islamic year of Hijrah, or the first day of the Christian year.
The Imam's share, which is 10%, is given to the Mujtahid of whom one is Muqallid, in order to be spent for charity purposes, the poor, etc. One is not allowed to dispose of the Imam's share without first obtaining the Mujtahid's or his agents permission.

Khums on spoils of war used to be the major source of revenue of the Islamic State during its expansionist period, particularly during the period of the Prophet and the right-guided caliphs.
Khums on the produce of the mines or mineral wealth was charged by the Islamic State at the rate of 20%.
Khums is also levied on what is extracted from the sea like pearls, ambergris, etc. It is reported that Hadrat Umar levied Khums on the pearls and appointed Yaali-b-Ummayah as tax collector.

The mosaic of Romans villa pavements of Suq Al-Kadeem, Dar Buk-Ammera, Al- Khums Group villas and Nerids of NW Libya were studied geochemically, petrographically and statistically.
XRD analysis results of mortar showed that quartz, calcite, and kaolinite were the cement forming minerals in these villas.
This would help in the conservation of damage pavements.
