Settlement of Native land claims and striking a balance between preservation and development of lands in Alaska was the intent of the Alaska Native Claims Settle Act (ANCSA) and the Alaska National Interests Lands Conservation Act (ANILCA).
ANCSA did not attempt to determine the number of acres to which the Alaska Natives might be able to prove an aboriginal title.
The Alaska Native Claims Settlement Act was hailed as a new departure for the resolution of aboriginal claims.

The Annotated ANCSA: How the Alaska Native Claims Settlement Act Came About
This was the dilemma that Alaska Natives faced, when, in the late 1950's and early 1960's, the State and sectors of the federal government began encroaching on what was felt by Alaska Natives to be their traditional lands.
It was assumed that Native children would receive the benefits of ANCSA through their parents and that, as owners of the land, Alaska Natives could create such institutions, as they felt appropriate, to protect the land for the benefit of future generations.
The Allotment Act was extinguished with the passage of ANCSA.

When Alaska became part of the United States in 1867, there was no provision in the law for private ownership in the new territory, except for the private individual property holders who had obtained written title to the land under the Russians.
ANCSA is unique worldwide both for its magnitude and for the use of corporate structure for management of the lands and monies paid.
This claim in the reasoning of some men would be just, and the second savage ought to depart in his canoe, and seek a continent where no prior occupant claimed the soil.

The Act established a system of village and regional Native corporations to manage the lands and cash payments, and made extensive provisions regarding the operations of the corporations.
The Act also required the Secretary of the Interior to withdraw up to 80 million acres of existing public land for specific consideration as new national wildlife refuges, national parks, national forests and wild and scenic rivers.
This new provision allows native Alaskans, who are Vietnam veterans (within certain parameters), to be able to obtain an allotment of not more than two parcels of federal land totaling 160 acres or less under the Act of May 17, 1906 (chapter 2469; 34 Stat.

But what’s really important to keep in mind when discussing ANCSA is that it is a document that was developed for a group of human beings who had a very real claim to their ancestral home in Alaska.

In their travels to dozens of towns and villages, reporters talked to hundreds of people from all walks of life, seeking the viewpoints of Natives, anthropologists, economists and historians across the state, along with the opinions of Native corporation executives and everyday shareholders.
We can never know how the history of the state would have evolved otherwise, but we know that ANCSA allowed the trans-Alaska pipeline to be built and allowed Natives to enter the world of business with their own corporations.
We also know now that, for many Natives in Alaska, ANCSA has had little effect on their lives and they struggle to retain important aspects of their traditions, languages and cultures in a world that seems to spin faster all the time.
