Aldus also challenges the district court's grant of summary judgment, claiming that a genuine issue of material fact exists as to whether Lawrence/XLS caused Aldus "property damage" within the terms of the policies issued to Lawrence/XLS by the insurers.
Aldus claims that the district court lacked personal jurisdiction over it because Aldus does not have sufficient contacts with California to subject it to jurisdiction in that state.
Aldus has not shown that litigation in California has been or would be "so gravely difficult and inconvenient" as to render the court's exercise of personal jurisdiction unreasonable.

Adobe Systems Inc. and Aldus Corporation have agreed to modify their merger plan so that they will divest Aldus' "FreeHand" professional-illustration software within six months after the merger, as part of a settlement of Federal Trade Commission charges.
In addition, the FTC alleged, developing and marketing a new professional-illustration program and repositioning existing pro- grams would be difficult and time-consuming, so competition from other firms after the merger would not be timely, likely or suf- ficient to deter anticompetitive effects.
In addition, for 10 years, the settlement would require Adobe and Aldus to obtain Commission approval before acquiring any stock or other interest in any firm engaged in the development or sale of professional-illustration software for the Macintosh or Power Macintosh.

The interesting thing about the timing of this whole situation is that we were asked to write this article in response to some not-so-happy responses to the editorial from the President of Aldus Corporation, Paul Brainerd, and Stan Wood who serves as a Technical Liaison for Zenith.
As for the issues that were discussed in the editorial, the one that appears to be the least encouraging for finding a solution is the speed issue of using PageMaker 3.0 on the Z-248.
Therefore, we believe that Aldus PageMaker functions adequately on the Z-248 and provides the user with a viable alternative in the field of desktop publishing as long as users have version 2.40 or higher of ROM or the NOSER.COM command to alleviate the hindrances and inconveniences of the system lockup problem.
