The title of duke of Albany was next bestowed upon Henry Stuart, commonly known as Lord Darnley, by Mary, queen of Scots, in 1565.
Albany, who was the ablest prince of his house, left by his first wife one son, Murdac (or Murdoch) Stewart, who succeeded him as duke of Albany and regent, but at whose execution in 1425 the dukedom became extinct.

John was a son of Alexander Stewart, 1st Duke of Albany, son of King James II of Scotland.
Albany was his whole life the next heir of the Kingdom of Scotland after male members of the king's immediate family, due to stipulations of the Semi-Salic succession order enacted by Robert II of Scotland which favored male agnates over all females of the Royal House of Stewart.
Thus Albany was from 1504 onwards either the heir presumptive or the second-in-line to the throne of Kingdom of Scotland.

About 1382 Sir Alexander Stewart (died circa 1404), "the Wolf of Badenoch", a son of King Robert II, became earl of Buchan, and Stewarts held the earldom for about a century and a half, although not in a direct line from Sir Alexander.
The most celebrated of the Stewart earls included the Scottish regent, Robert, duke of Albany, and his son John Stewart, who became a constable of France and was killed at the Battle of Verneuil in 1424.

It was next granted to James' other son, Alexander, Duke of Albany, but the title was then declared forfeit because of Alexander's alliances with the English.
After the death of Alexander Stewart, his lands were passed to the Sovereign in accordance with the charter, and thereafter were disposed of by the Crown.
