The High Court dismissed the petition taking the view that since the house was taken away from the appellant's use for a temporary period only he did not stand deprived of his property, and, therefore a detailed procedure was not necessary.
The petition was dismissed summarily by a Division Bench of the High Court.
In the second case, the High Court held that the decision of the District Magistrate that there existed a public purpose and a particular accommodation was needed for that purpose was final and could not be questioned in a court of law.

The Registry of the High Court at Lucknow reported that the petition related to the District of Shahjahanpur and question was raised as to the competency of the writ petition being presented before the Bench sitting at Lucknow.
It is on this reasoning that the High Court strictly confined the jurisdiction of the Lucknow Bench under Article 226 to the right which the petitioner pursues throughout the original proceedings, the appellate proceedings and thereafter in the High Court.

 UP High Court Directive
There are already two Mandamus issued by the Allahabad High Court in the case of Uttarakhand Sangharsh Samiti State of UP, Hari Krishna Maheswari asking the state of UP to constitute State Human Rights Commission and Human Rights Courts.
The Court in its judgement stated that the state of UP was a party to the 'Uttarakhand' and 'Maheswari' cases and the request made there by this court could not be taken lightly.
The court expressed its anguish and said, after perusal, we find that unfortunately the records have not been produced in their entirety in as much as we do not find on record as to how the matter was considered by the Cabinet and what had happened allegedly on 22.10.'98 in the Cabinet Meeting.

Ranchi, April 28: The Lucknow bench of the Allahabad High Court has issued a contempt notice to the subdivisional judicial magistrate (SDJM) of Ranchi, Virendra Pratap, for not complying with its order in connection with a dowry case.
The high court had directed to stay the legal proceedings till disposal of a similar case filed by Srivastava in the high court.
Allahabad High Court issued contempt notice asking why Pratap should not be tried and punished on account of non-compliance with the order (dated January 25, 2006) passed by the high court in a writ petition.

The Supreme Court today stayed the interim order of Allahabad High Court directing the authorities in Uttar Pradesh to seize and destroy "jugad" vehicles across the state for "causing loss to the exchequer and endangering the lives of the travelling public".
The High Court order was passed on a PIL filed by one Avinash Kumar seeking directions to the transport authorities and police to seize and destroy these vehicles.
The petitioner before the apex court had alleged that the impugned order was grossly violative of the principles of natural justice as no opportunity was given to the farmers to address the court.

The court has observed that it is not disputed that Suhail Siddiqui is the son of Zuhair Siddiqui, the brother of Muslim Siddiqui, living in Pakistan and is an heir of the deceased under Muslim law.

The Lucknow bench of Allahabad High Court had on March 5 directed the ASI to excavate the disputed site to determine whether a temple pre-existed the Babri Masjid.
But the Supreme Court rejected the argument, saying no fundamental right was involved in the matter and if at all the petitioner wanted to challenge the high court order, a special leave petition was the only remedy.
Closer to the scene of action, court battles kept pace with the digging as the special bench of Allahabad High Court in Lucknow reserved its verdict on how the excavation could be conducted with greater transparency.

Three election petitions were filed in the Allahabad High Court challenging her election on the grounds that she, being an Italian citizen, did not satisfy the prerequisites for registration as a citizen of India.
The Allahabad High Court dismissed the petitions on May 20, 2000 on the plea that a challenge relating to citizenship or the constitutionality of the Citizenship Act itself could not be adjudicated upon by the High Court in the course of considering an election petition.
The High Court also held that the citizenship certificate granted to Sonia Gandhi was final and binding, and unless it was cancelled by the Central government the issue could not be questioned as part of an election petition.

Allahabad, Sept 22: Students of Allahabad University on Friday opposed some recommendations of the Lyngdoh Committee to student union elections and burnt an effigy of former Chief Election Commissioner J M Lyngdoh, who headed the panel.
The protestors, led by Allahabad University Students Union president Ajit Yadav and vice-president Brijendra Mishra organised a procession in reaction to the order issued by the supreme court for implementing the recommendations of the committee.
The candidature of Yadav has been challenged in the Allahabad High Court, which has directed that he can continue to hold the post but without functioning as such.

New Delhi: The Supreme Court on Tuesday expressed displeasure over the tone and tenor of Uttar Pradesh Governor T V Rajeswar’s letter to the chief justice of the Allahabad High Court on the issue of the transfer of his legal aide Pradeep Dubey to Ballia as an additional district judge.
It also ‘requested’ the Allahabad High Court not to proceed further with the hearing on the case, but made it clear that the HC will have primacy in the transfer and posting of judicial officers in any of the offices under the executive.
The high court and the governor have been at loggerheads on the issue of the transfer of Dubey.

Allahabad, Aug 22: The Allahabad High Court today directed the Allahabad University authorities to start the five year LLB course from the 2006-2007 academic session.
The order has been passed allowing a writ petition of one Abhilasha Sharma of Allahabad, who had moved the court saying that though applications were submitted by students for the LLB (five years) course, the university had not began classes.
The court further directed that enterance examination and admission process shall be completed within 45 days and that those students who have already applied in pursuance of advertisement for 2005-2006 session shall also be considered for admission and they need not move a fresh application.
