Topic: Allens rule

  No. 01-3404
The Allens made complaints to Maki concerning the condition of the premises, the timeliness of repairs and access to the basement for storage and laundry hook-up.
The Allens assert that Maki's decision to terminate their lease was a retaliatory eviction and that the trial court erred by finding otherwise.
The effect of the Allens' interpretation is that a landlord may not choose not to renew a lease at the end of a lease term whenever a tenant makes a complaint to a housing code authority.

Negotiations between the Allens and the Vendors led to the execution of a purchase agreement.
Allen testified he did not consider Rush to be his agent, and Rush testified that he was acting solely for the Vendors.
An administrative rule governing conduct of real estate agents and brokers, requiring prompt tender to the Vendor of every offer to purchase, does not create a private cause of action in favor of the prospective purchaser against an agent of the Vendor for whom the agent was acting as the exclusive broker.

the water depth was 9 feet so the usual 7:1 rule would have said that 65 ft was enough, with 150 ft out he took up all the room and was rude about it too.
about half way thru our pitcher they started apologizing for their rule about reservations and a bit later decided we could have something from their small lunch menu if we wanted.

The rules further provide that the notice of appeal “shall designate the judgment or order from which appeal is taken and the court to which appeal is taken.
As a general rule, the appellate court obtains jurisdiction only over the rulings specifically designated in the notice of appeal as the ones from which the appeal is being taken.
As exceptions to the general rule, there are two situations in which the appellate court may liberally construe a notice of appeal to determine it has jurisdiction over a ruling not specified in the notice.

In their complaint, the Allens alleged that White insisted on having a wire gate across the cattle guards that they installed at each end of their easement, and that she otherwise interfered with their use of the easement, as well as their tenants' and visitors' use of the easement.
The [Allens'] use of cattle guards in place of gates does not materially increase the burden on the servient estate held by [White], however, opening and closing of two different gates each time one enters or leaves the dominant estate is quite burdensome.
The [Allens] should be allowed to maintain in place their cattle guards instead of gates on the easement in order to improve their convenience of using the easement.

Moreover, its not like Allen has had some big win with any of his investments, so I don't know where he gets off knowing that two of the four founders need to be replaced in his example.
Not at all, Allen is doing what he does because he respects entrepreneurs and as a VC, he desperately needs us.
