No. 04SA178. People v. Turner, Jr. - March 28, 2005 - Colorado Supreme Court Opinions
In response, defense counsel filed a Motion to Compel with the county court, arguing that records of assistance provided by the Alliance to M.P. were properly discoverable because the victimadvocate privilege only applies to communications made by a victim of domestic abuse, and not to "assistance"provided by the organization.
The Alliance counters that the victimadvocate privilege must be construed to include all communications between the victim and the agency, including records of assistance provided.
As to the first issue, we note that the trial court clearly treated the Alliance as an advocate within the meaning of the statute; the record indicates the Alliance’s contact with the alleged victim was in that capacity, and the defendant points to no contrary facts.
