In 2002 Amfac declared Chapter 11 bankruptcy and emerged as Kaanapali Land, LLC.

Amfac counters that the trial court correctly denied WBIC's punitive damage claim because "there is an absence of clear and convincing evidence that Amfac breached the Indemnification Agreement maliciously or wantonly." Award or denial of punitive damages is within the sound discretion of the trier of fact.
