ANGELICA — On Election Day earlier this month town of Angelica residents voted down a referendum calling for a 30-acre expansion of the Hyland Landfill Facility.
Town Supervisor Craig Schlau said he knew Hyland distributed flyers and the town printed several articles in a local publication to spread the word about the vote.
Schlau added that the articles published by the town showed the tax rate with Hyland paying taxes, comparing that to what the rate would be without the landfill in the town.

Hyland challenged Angelica's landfill ban law in federal District Court under the Commerce Clause of the U.S. Constitution, claiming that it discriminated against interstate commerce in waste.
In return for an end to what looked like unsustainable legal costs, the Angelica Town Board  last year complied, and took Hyland at its word that it would not seek a permit modification to expand the kinds of wastes the proposed ash dump receives.
But the Town Board instead signed an agreement guaranteeing that it would never seek independent party status in any further permit proceedings involving Hyland.

A State Comptroller's audit of the Town of Angelica claimed that the Town was holding unreserved and unappropriated funds equalling 48% of its budgetary appropriations for the year 2000.
Angelica Town Supervisor Craig Schlau responded to the audit by saying that a large percentage of the unreserved and unappropriated money was realized from tipping fees from the Hyland Facility.
Town Councilman Gary Nevinger reported that the “highway department is always a big factor” in the budget because of the costs of repairing and maintaining equipment.
