Animals used in experiments to determine the lethal dose or lethal concentration of a substance shall be put down painlessly as soon as it becomes clear that they are dying under the action of the substance.
Animals to be kept alive at the end of the experiment must receive the care appropriate to their state of health, be placed under the supervision of a veterinarian or another qualified person and be given any medical care that might be necessary.
Persons engaged in animal husbandry or operating an establishment or enterprise under paragraph 1 (1), (3), (5) or (6) may be obliged by the competent authority in individual cases to designate a competent, responsible person authorized to give instructions for meeting the requirements of this Act and of the ordinances issued on the basis thereof.

 Animal Welfare Act
All animals delivered for transportation, transported, purchased, or sold, in commerce, by a dealer or exhibitor shall be marked or identified at such time and in such humane manner as the Secretary may prescribe: Provided, That only live dogs and cats need be so marked or identified by a research facility.
The Secretary shall designate additional kinds and classes of animals and may prescribe different ages for particular kinds or classes of dogs, cats, or designated animals, for the purposes of this section, when he determines that such action is necessary or adequate to assure their humane treatment in connection with their transportation in commerce.

ASNS opposes AWA regulation of rats and mice because it is (1) unnecessary from the perspective of animal welfare, and (2) will impose significant administrative and financial burdens on researchers and the USDA.
AWA regulation is not needed to provide humane care standards for the vast majority of rats and mice, which are already being cared for in accordance with the ILAR Guide for the Care and Use of Laboratory Animals.
If animals that are bred for the purpose of research, such as rodents, are included then the work days dedicated to animal inspection are likely to triple in order to inspect each room and facility adequately on an annual basis.

Animal: any live or dead dog, including those used for hunting, security or breeding purposes, cat, monkey, guinea pig, hamster, rabbit or other warmblooded animal used or intended to be used for research, testing, experimentation, exhibition or as a pet, but excluding farm animals.
Animal fighting venture: an event that involves a fight between two or more animals and is conducted for sport, wagering or entertainment, excluding hunting activities.
Additional standards are required for animals in research facilities, including: minimization of pain and distress; consideration of alternatives to procedures likely to cause pain and distress; use of tranquilizers and anesthetics when pain is involved; use of animals in no more than one major operative experiment from which it may recover.

The Federal Laboratory Animal Welfare Act commonly referred to as the Animal Welfare Act, was enacted in 1966 to protect owners from pet theft, prevent use of stolen pets, and ensure the humane treatment of research animals.
In 1971, the USDA amended the definition of animal to incorporate the 1970 amendments to the Act and to specifically exclude birds, rats, and mice for enforcement purposes.
The Farm Security and Rural Investment Act of 2002 included the Helms Amendment which amended the definition of animal in the AWA by specifically excluding birds, rats of the genus Rattus, and mice of the genus Mus, bred for use in research.

A person is guilty of animal neglect when he has custody or ownership or both of an animal and fails to provide adequate care or adequate control, including, but not limited to, knowingly abandoning an animal in any place without making provisions for its adequate care which results in substantial harm to the animal.
Animal neglect is a class C misdemeanor upon first conviction and for each offense, punishable by imprisonment or a fine not to exceed five hundred dollars, or both, and a class B misdemeanor punishable by imprisonment or a fine not to exceed one thousand dollars, or both upon the second and all subsequent convictions.

The AWA is, in the main, a regulatory law that seeks to control who may possess or sell certain animals and the living conditions (for non-agricultural, domestic animals) under which the animals must be kept.
The powers conferred by said sections 9 and 10 of the Act of September 26, 1914, as amended [15 USCS §§ 49, 50], on the district courts of the United States may be exercised for the purposes of this Act by any district court of the United States.
