Topic: Anselm of Lucca

  St. Anselm
Anselm replied, that he was not afraid of suffering, or even losing his life in the cause of God; but that he saw there was nothing to be done in a country where justice was so overruled as it was in England.
Anselm spoke to the point with so much learning, judgment, and penetration that he silenced the Greeks and gave such a general satisfaction that all present joined in pronouncing Anathema against those that should afterwards deny the procession of the Holy Ghost from both the Father and the Son.
Anselm had a most lively faith of all the mysteries and great truths of our holy religion; and by the purity of his heart, and an interior divine light, he discovered great secrets in the holy scriptures, and had a wonderful talent in explaining difficulties which occur in them.

Anselm's collection was one of several legal compendia composed during the 1070s and 1080s.
For his part, Anselm derived his defense of papal supremacy from the pope's caritative duty to preserve the well-being of the Church, and thus the canonist linked papal authority with the pastoral responsibility to do what was necessary.
Anselm's approach was pro-active, aggressive in its goal of confronting and incorporating dissidents, whether willingly or by force.

In addition, Gratian's Decrees ascribe the last 5 canons to the earlier pontificate of Urban II (1088-99) and not to the time of Lateran I, as Br noted; therefore alpha seems right to omit these five canons.
The document on which Br and possibly Rm depend is a Vatican codex "which contains the Collection of Anselm [of Lucca], in which the canons of this council are included as an appendix after chapter 55".

 Necessitas legem non habet
The Pseudo-Isidorian forger first gave the concept its classic form in the early Middle Ages when he argued that the sacred rites should not be celebrated in non-consecrated places, "nisi pro summa necessitate contingat, quoniam necessitas legem non habet" (except when there was great necessity, because necessity knows no law).
Anselm of Lucca and Gregory, cardinal of Crisogono, included the letter in their collections, from which the compiler of De consecratione took for his appendix to Gratian's Decretum.
Surprisingly the most widely used collections of the eleventh and twelfth centuries, Burchard of Worms and Ivo of Chartres, did not include this chapter.
