Although the law creating the Antietam National Cemetery corporation designated the new cemetery for the reinterment of soldiers from both sides, no Confederate dead were ever buried there.
In 1865, the Maryland General Assembly passed an act creating the Antietam National Cemetery, which was to be governed by trustees appointed by Maryland and other interested states.
These trustees were to oversee the removal of the dead from Antietam to the new cemetery, taking care that the remains of Confederate soldiers were buried in a section of the cemetery distinct from the area designated for Union reburials.

By the Spring of 1864 a Nation wearied by three years of Civil War, tragic battles at places like Shiloh, Antietam, Gettysburg, Chickamauga and others, waited desperately for an end to war.
While the cemetery that surrounds the ornate structure is one of only two such sites operated by the United States Army, Arlington House and the grounds surrounding it are administered by the National Park Service.
Arlington House itself was subsequently dedicated to the memory of Robert E. Lee, and in 1914 President Woodrow Wilson dedicated a special memorial to the Confederate dead of the Civil War at Arlington.
