In computing, software that is copyrighted and licensed under a software license is done so principally under two categories of licensing schemes.
Software may be published without an accompanying license, as License-Free Software, in which case it remains copyrighted, its distribution is subject to ordinary copyright law, and its sale is subject to ordinary sales law.
Software may also be released to the public domain, in which case it is not copyrighted and the notion of a copyright license simply does not apply at all (although the other parts of a software licence, including warranty provisions, will still apply to the sale of such software).

An open-source license is a copyright license for computer software that makes the source code available under terms that allow for modification and redistribution without having to pay the original author.
Some software licenses define an open standard basis and may or may not be similar to open source, like some versions of Solaris and PGP.
Software in the public domain (that is, with no copyright license at all), meets those criteria as long as all source code is made available, and is therefore recognized by the OSI and entitled to use their service mark.

We are also in the process of updating the Apache licenses to reflect changes in the community regarding patents and contributing.

The problem with Apache License 2.0 is that although in practice it is as unrestrictive as BSD license, there is no way to redistribute APL and GPL code together at all due to the patent clause.
Another problem is that the simple fact of using the APL software places an additional restriction on the user as he has to give up the right to initiate a patent litigation even for defense purposes to continue to use the software.

Apache Harmony, a project which plans to create an open source implementation of Java, has called on the Java business community to donate software.
Geir Magnusson, a board member at Apache Software Foundation, said developing open source implementations of all parts of the Java platform will be difficult, but he hopes to speed things along by persuading companies and free software projects to contribute code.
However, it has been reported that James Gosling, one of the creators of Java and now a senior Sun executive, is sceptical about Apache Harmony, although he seems to be more supportive of the idea of simply opening up the source code of Java itself.
