To suggest that guaranteed representation of Te Arawa on the to-be-created Lakes Forum (a move that in my view is required in any case due to the shocking state of the lakes in question) is due to race is simply wrong.
Under the doctrine of aboriginal title, Te Arawa probably could have succeeded in Court - there was no action by the Government to extinguish their title over the lake bed, and furthermore the status of the lakes was never expressly mentioned in the 1880 agreement.
In the case of Te Arawa and the 1922 settlement, it seems that this was clearly the case.

 Te Arawa Lakes Settlement Offer
Prior to 1922, the Native Land Court was hearing evidence to determine the ownership of the Rotorua lakes.
Discussions with the Crown on the settlement of the claim began in 1989, but no progress was made until the then Government agreed in 1997 to exempt the Trust Board's claim from the policy of requiring all settlements to be a comprehensive resolution of all a claimant's grievances.
The Te Arawa Maori Trust Board's Deed of Mandate to negotiate a settlement for the lakes claim on behalf of all Te Arawa was recognised by the Government in December 1998.

The decision to accept was made by the Te Arawa Maori Trust Board and its negotiators after receiving a letter from Minister of Treaty Negotiations Margaret Wilson and the Office of Treaty Settlements on Thursday.
The vesting of the lakebed titles meant that Te Arawa would be the owners of the lakebeds and have certain 'ownership rights' and a say over matters relating to the lakes, the negotiators said.
Part of accepting the offer meant that Te Arawa had to guarantee the public the right to use and access the lakes and that the interests of commercial users and structures would be protected.

ARAWA is a mid 60's design and is of classic lines, with large overhangs and a fairly short LWL, 34 ft., compared to her overall length, LOA, of 50 ft. And, she is a moderately heavy to heavy design and construction, especially in her full cruising configuration (engine, fuel, water, refrigerator, air conditioner stove, etc.).
ARAWA was the first such canoe to reach New Zealand, in the area of the Bay of Plenty, such landing place becoming the tribal homeland for the ARAWA tribe of the Maori people descendant from those aboard the sailing canoe ARAWA.
ARAWA reached her berth at Green Cay Marina on St Croix at mid morning, Saturday, June 23, after being sailed uneventfully for the 500 nm from Provo by Captain Patrick Secker and 2 crewmen.

Mair, with 100 Te Arawa, attempted to cut off the retreat from the rear of the pa. For his part in the actions at Te Koutu and Puraku Mair was promoted to lieutenant on 25 April 1867.
In 1922 Te Arawa voted Mair an annuity of £100 for his lifetime from the Arawa Lakes Fund.
His funeral cortège, in procession from Tauranga to Rotorua, was received and farewelled by Te Arawa on their marae at Maketu, Taheke, Ohau and Ohinemutu.
