Ashton Tate consisted of George Tate, Hal Lashlee, Nelson Tso and Myself.
He held the position of Director of Product Quality at Ashton Tate where he was responsible for the quality of all products released by the company, which had $400M/yr.

d2r: ashton tate and SCO v. IBM
Ashton was a macaw that lived in the lunch room at George Tate's software company, Ashton-Tate, home of dBase II, the first successful microcomputer database.
There was George Tate, himself, who died at his desk when he was only 40, but still managed to get married two weeks later (by proxy -- please explain that one to me).
There was the macaw, of course, which was named for the company, not the other way around.

 dbase.htm
There never was an Ashton and there never was a dBase I. But the II inspired greater confidence on the part of the buyer (that the bugs had been ironed out in version I), and Ashton-Tate sounded more British/European, giving it an International flavor.
The IBM PC version was called dBase II and the company formed was Ashton-Tate.
Tate bought the rights to Vulcan and hired Ratliffe for the new company formed to create the IBM PC version and market it.

The funny part was that Ashton the bird (who sat in a nearby atrium) had a habit of frequently squawking something that sounded like "Bad Ap!".
The founder of the company, George Tate, had died of heart attack 3 months previous.
(It should be noted Ashton worked out to be a bird.) The director of support was Jay Hansen, the manager was Roy Moore.

According to Ross, once it became clear to Wigginton that Ross and Bravo were not interested in having Ashton-Tate publish the spreadsheet, Wigginton informed Ross that he was going to work for Ashton- Tate and was going to take the user interface portion of the MacCalc prototype with him.
On April 4, 1989, the district court issued a published order granting Ashton- Tate's motion for summary judgment on all issues.
The court held that even if there was an agreement to collaborate, Ross's contribution of ideas to the user interface written by Wigginton was insufficient to make Ross a joint author of the interface.

I, Cringely . June 19, 2003 - What Goes Around Comes Around PBS
Think about it.  Ashton-Tate's claim on dBase was, in many ways, similar to SCO's current claim on derivative UNIX works.  They both ignored upstream property rights of others.  What is ironic about this is that Fox Software wasn't the only company sued by Ashton-Tate for this supposed copyright violation.  Fox's co-defendant was SCO.
Which brings us back to Ashton the macaw.  When Ashton-Tate sued Fox Software for copyright infringement in 1988, the suit was eventually thrown out because Ashton-Tate was shown to have made false statements in its original copyright application for dBase II.
Unfortunately, it would take IBM months to recognize such a golden opportunity and more months to approve a plan.  Probably every IBMer who sells or supports products in this "space" (IBMspeak) understands the situation.  But when your leadership is too unaware and too lethargic, well opportunities are missed.

An Open Letter to the Dbase Language Community Re Ashton-Tate/Fox Software Lawsuit Fox Sof
According to George Tate himself, this marketing strategy was calculated to extend the acceptance and influence of the dbase language as widely as possible and, thereby, to maximize Ashton-Tate's market share.
Ashton-Tate's only concern was possible infringement on the trademarked name "dBASE"; at no time did Ashton- Tate suggest that the use of or the attempt to standardize the language constituted copyright infringement.
In January of 1984, Fox Software advised George Tate, CEO of Ashton-Tate, and Wayne Ratliff, then an Ashton-Tate Vice-President, that Fox had developed a dBASE II workalike.

 Database marketing secures Oracle future
The Ashton-Tate story got interesting when the company founder, George Tate, died and Es Esber, his second-in-command, took over.
DBase was one of the first desktop relational databases, and the DBase file format still lives on in products such as XBase and Microsoft Foxbase.
Esber fancied himself as a business guru and intended to bring a bit of 'professionalism' to the company.

Originally dBase IV was supposed to have provided a dev tool/front end for SQL Server (hence the original partnership) but the problems with dBase IV after its release later in the year led to this falling by the wayside.

Ashton-Tate approached Fox in November of 1986 on the pretense of purchasing FoxBASE+ and marketing it as a developer's version of dBASE III Plus.

According to Ross, once it became clear to Wigginton that Ross and Bravo were not interested in having Ashton-Tate publish the spreadsheet, Wigginton informed Ross that he was going to work for Ashton- Tate and was going to take the user interface portion of the MacCalc prototype with him.
In March, Wigginton made a presentation to employees of Ashton-Tate, one of the Nation's largest software publishers, to see if Ashton-Tate might be interested in publishing the spreadsheet program he and Ross were developing.
While the court was correct to hold that the user interface is not a "joint work" as a result of Ross's contribution to the interface itself, the court did not resolve whether Ross's copyrightable contribution to the engine of the MacCalc engine entitled him to an undivided interest in the entire prototype, including the interface.
