The position of the ultra-legalists, mainly represented by the TPLF government, and whose basic argument is that Assab belongs to Eritrea by virtue of colonial treatises.
Assab should not be included for the simple reason that under the Derg it had an autonomous status.
This attempt to isolate the case of Assab while accepting the independence of Eritrea is damaging in that it suggests that the incorporation of Eritrea had nothing to do with the historical right of Ethiopia and with the noble cause of reuniting the forcefully detached province with the motherland.

Assab, long a preferred port of Ethiopia when it was part of Ethiopia, and later when it reverted to Eritrean jurisdiction, is once again in the limelight as arguments fly back and forth about the practicality of using the port for massive grain supplies expected in Ethiopia to overcome the effects of the current drought.
Yet other proponents of the "use Assab" theory are unabashed hypocrites who only yesterday were engaged in delaying the supply of grain to Ethiopia for political reasons, and who today want to cover their backs now that the public is in outcry because matters have been allowed to deteriorate to this level.
More ominously, there are also those that wish to raise the issue of using Assab for political reasons, to pressure Ethiopia to accept a cease-fire without the express commitment of Eritrea to withdraw from territories it occupied in May 1998 as provided for in the OAU Framework Agreement and the 'Modalities' document.

In case of a forcible restoration of her rights over the Assab Region, these same foes are going to raise the principle that nations may not resort to force in the settlement of international diputes.
Eritrea’s insistence to hold on to the Assab region is for the same purpose, as evidenced in her abuse of control of the port by confiscation, imposition of arbitrary custom duties, and the harassment, detention, murder, and dislocation of Ethiopians.
Moreover, for Eritrea the Assab Region is only symbolic and being so far away from Eritrean centers of activity, difficult to manage and defend, especially given the hostility and current war of liberation of the Afar inhabitants, and a more powerful state always waiting to restore the territory to its former and rightful status.
