Downplaying the burden on business growth that the new law would impose, Cordero Badillo said companies or individuals petitioning the OMA not to grant a permit would have to present sufficient evidence that, in fact, the expanding company could monopolize the market.
Cordero Badillo also said the board couldn’t take more than 90 days to evaluate the expansion plan’s effect on the market.
Cordero Badillo explained that the OMA would use the Herfindahl-Hirschman Index–a well-known and commonly accepted indicator of market concentration–as well as Federal Trade Commission guidelines to determine whether a company’s growth plans would constitute a monopoly.

El empresario Atilano Cordero Badillo, presidente de la Cámara de Mercadeo, Industria y Distribución de Alimentos (MIDA), sostuvo que si la reforma que finalmente se imponga contempla un impuesto al consumo, se debe seleccionar aquel que menos efecto multiplicador provoque en los precios de los productos.
Cordero Badillo no identificó qué impuesto entre el IVA o el “sales tax” tiene más efecto multiplicador.
Leonardo Cordero, presidente de la Cámara de Comercio de Puerto Rico (CCPR), señaló por su parte que aunque la organización se ha expresado a favor del “sales tax”, en esta ocasión no se van a expresar a favor de ninguno de los métodos impositivos en vista de que el IVA ha generado gran interés.
