Atrios didn't pull out a penal code and specifically go down the elements of "stalking" and then argue that since Luskin may have met the elements, that qualifies him as a stalker.
On a related matter, Atrios can argue that truth is an affirmative defense--that since Luskin admitted to stalking, Atrios is justified in calling him a "stalker." Luskin may reply that he was just being facetious about himself, but there is no evidence to suggest that Atrios was not being similarly sarcastic about Luskin.
Atrios is not even remotely liable for the statements and publications of others.

Atrios a/k/a Duncan Black, the popular blogger responsible for Eschaton, has slammed Glenn Reynolds (of Instapundit) for wearing this "celebrate diversity" shirt.
If Atrios wanted to single out a Republican or "right-winger" to criticize for being racist or fascist he has plenty of deserving targets.
The right is no more immune from wackos and hate mongers than the left is. But for Atrios to go after someone like Glenn Reynolds, a man who many conservatives criticize for not being right-wing enough, for being "the transmitter of some truly hateful ideas" is lunacy, plain and simple.

I recall Atrios' last lunacy, of August, when he claimed that Glenn Reynolds, by posing in a fl, red, green, & yellow "gun diversity" tee-shirt was advocating murder of fls, those being the pan-African colors.
Atrios wasn't criticizing Reynolds because of his shirt, but because of another, similar shirt.

The proper way to disprove that theory is to dig up a substantial number of white NYT journalists guilty of widespread fraud and plagiarism, and establish that, as with Blair, the higher-ups at the NYT knowingly allowed them to continue with their activities.

Maybe I just read it differently than you did, but I didn’t get the sense that Atrios was really disagreeing with what Marshall was saying, just wishing that Marshall had had a better focus, namely, toward those people who are consistently giving to incumbents who don’t need the dough.
There’s a third reason Atrios is wrong — the TPM guest poster was specifically addressing Progressive support for the Lamont campaign, making the indisputable point that the blogosphere portion of the progressive movement has basically shot its entire wad on the Lamont campaign.

Just a day after I denounced conservatives for manufacturing a conspiracy to suggest that John Roberts is gay, Atrios has made the same suggestion, even though the judge allegedly described in the story was reportedly removed from contention:
It wasn't clear to me given that the "joke" was combined with a suggestion that he wants to out the judge in the Signorile story, nor was it clear to his commenters who read it the same way.
Update 7/26: A further thought about this -- you would think Atrios would understand why his intent might be confusing when he jokes about a phony conspiracy to suggest Judge Roberts is gay while endorsing the outing of a gay conservative in the same post.

While I think the Zeran decision is right, and would likely apply to the automated posting that applies to blogs in any circuit, the amount that a blogger would have to expend to vindicate this position, and the certainty of victory, obviously depends on where he lives.
And in the case of Atrios, we don’t know where he lives, because “Atrios” is pseudonym.
Atrios has mentioned in prior posts that he lives in Pennsylvania, in or around Philadelphia.

I doubt Atrios cares much one way or the other, but for Luskin, who obviously can't stand Krugman's fame (and his New York Times soapbox) it may be just what he's looking to get out of all this.
All Atrios needs is one call for free help from the lawyers at the UCLA and thus send a letter to law firm of Hanify & King.
It doesn't accuse Atrios of libel, but he wants the whole post and the comments (where the libel allegedly is) taken down, although Luskin wouldn't say which bits were libellous.

I'd have more symphathy for Atrios but I couldn't find where he had any sympathy for those who are normally targeted in the "real world" - those with deep pockets.
And while there was much rejoicing, inquiring minds wonder if Atrios had to remove any comments and/or agree to remove comments of a particular nature in the future.
