The Maryland attorney general's office has contradicted one of its staff lawyers and allowed St. Luke Institute, the Silver Spring psychiatric hospital that treats Catholic priests who have sexually abused minors, to continue its policy of not reporting suspected abuse to authorities if it occurred outside Maryland.
In a letter last week, Deputy Attorney General Carmen M. Shepard declared that Maryland health care practitioners are not obligated to tell law enforcement agencies about suspected abuse outside the state unless the alleged victim currently lives in Maryland.
Wendy Kronmiller, an assistant attorney general who advises the state Department of Health and Mental Hygiene, had said in a June 12 interview that Maryland law requires health care providers to report suspected child sexual abuse, regardless of its location.

The Attorney General responded that as currently operated it is not lawful to place such a bet, but that it might be possible for the service to be re-configured so as to comply with the Maryland telephone wagering regulations.
Several state attorneys general have concluded that state criminal laws concerning gambling prohibit a person from using the Internet from within a state to participate in gambling activities, even if those activities are legal in the jurisdiction in which the computer providing the service is located.

In June 1997, the Johns Hopkins University Bioethics Institute and the Maryland attorney general's office announced the formation of a partnership to investigate ways to improve End-of-Life care and eliminate the medical and legal barriers to effective palliative care for terminally ill patients in Maryland.
Its objective was to develop a preliminary understanding of the problems involved in the care of the dying in Maryland and to identify state policy initiatives that would complement and facilitate efforts in the health care system to improve the care of the dying.
A subcommittee of the attorney general's Advisory Board worked with staff at the Hopkins Institute to draft a statewide plan of action that was proposed for funding under this program.

Maryland's original HMO statute did not address whether an HMO memeber could be liable to a provider for any portion of the cost of medical care provided.
No one would suggest that the General Assembly, indefining the term "provider," as it did, intended to creat a system of managed care in which the health care delivery system ended at the Maryland border, depriving many Maryland HMO members of the opportunity to obtain needed care close to their homes.
The rules relating to balance billing under Maryland law apply to an out-of-state provider unless that provider is not under contract with a Maryland licensed HMO and does not have the minimum contacts with Maryland that would permit application of Maryland law to the provider.

The Attorney General of Maryland has filed suit against a landowner challenging the use of an Indemnity Deed of Trust (IDOT) to avoid payment of recordation tax.
If the landowner is not primarily liable, but is liable only, under the deed of trust it is granting, in the event of a default by the actual maker of the note, no tax is imposed on the theory that the current debt has not been incurred by the landowner.
The Attorney General argues in its pleadings that the presented note shows that a current debt was incurred by the landowner and tax was due.

Doug Gansler, State's Attorney for Montgomery County, Maryland, won the Democratic Party's nomination in the primary elections on September 12, defeating Stuart O. Simms 55.7% to 44.3%.
Another Democratic candidate, Tom Perez, was eliminated before the primary elections by a Maryland Court of Appeals ruling that had found that Perez had not practiced law in Maryland for ten years, which is the minimum requirement to run for the office of Attorney General.

Maryland Attorney General J. Joseph Curran is proposing a wide-ranging package of laws that would make the state's gun control regulations among the strictest in the nation and says his ultimate goal is a ban on handguns.
The attorney general said he supports the governor's proposal, as well as legislation that would make illegal gun possession and sales a felony.

Joseph Curran, Jr., announced today that Angelo Reynolds, 38, of the 8000 block of Harvest Bend Lane in Laurel, and his company, MYPO, Inc., were charged with felony Medicaid fraud and felony theft in a pair of 42 count criminal indictments filed in Baltimore City Circuit Court.
The case is being prosecuted by the Medicaid Fraud Control Unit (MFCU) of the Maryland Attorney General’s Office.
The case was referred to Attorney General Curran’s Medicaid Fraud Control Unit from the Mental Hygiene Administration which administers mental health services for the Department of Health and Mental Hygiene.
