There are precedents for appointment of a completely new Court of Appeal – in Victoria and Queensland in the late 1990s, the state governments of the day appointed permanent Courts of Appeal along the lines of the New South Wales and New Zealand models.
Those appointments were made at a time when New Zealand was a completely different society, one which was far less litigious, in an era predating the massive growth of administrative and public law and the introduction of legislation like the Bill of Rights.
Guest appearances by overseas judges provides no additional benefit to New Zealand, and the suggestion that they could operate as a check on our system is insulting to the judiciary and to this country.
