Audible, based in Wayne, N.J., is the third company Digeo has sued alleging infringement on its patent, which was filed in 1996 and granted in 1998.
Digeo's lawsuit claims that Audible's method of selling and distributing audiobooks is "functionally indistinguishable" from the electronic book distribution system described in its patent.
