Australian criminal law refers to the criminal laws of the several jurisdictions in the Commonwealth of Australia.
Australian criminal law was originally received from the English common law, which continued to evolve in Australian courts.
Criminal offences under New South Wales law are based on the common law and some statutory provisions in the Crimes Act.

The current state of development of the law in New Zealand is such that, while we may be reasonably sure that a trial judge would warn the jury, if he did not, we cannot be sure that an appellate court would regard that omission as a substantial miscarriage of justice.
Australian courts regard the Longman direction as being "a vital requirement for a just trial in a case of long delay" (para 109).
The common law antecedent of these directions is known as the Turnbull direction, originating in the English Court of Appeal’s decision R v Turnbull [1977] QB 224.
