The appellant rejected BC Tel’s severance offer and took the position that his employment was terminated without just cause and without reasonable notice or pay in lieu of reasonable notice.
B.C. Tel took the position that they had just cause for the appellant’s summary dismissal, alleging that he had been dishonest about his medical condition, and the treatments available for it.
In a document entitled “History of High Blood Pressure and BC Tel Involvement”, which was introduced as an exhibit at trial, the appellant stated that another one of his physicians (Dr. Andersen) refused to prescribe beta blockers because of their “unacceptable side effects”.

On April 29, 1986, BC Tel filed an application with the Board seeking a declaration that an unlawful strike was in progress and that the TWU had authorized or declared the unlawful activities.
David Grundy complained to the Board that B.C. Tel was treating him in a manner contrary to the Canada Labour Code as a direct result of a previous complaint made by him under the Code which was heard and adjudicated upon by the Board some months earlier.
This case is another in the series of attempts by persons employed by BC Tel and not presently represented by a trade union to gain representation through a bargaining agent.
