Ballot Access News is a monthly newsletter [1] edited and published by Richard Winger of San Francisco, California.
American ballot access laws typically require independent and minor political party candidates to collect a certain number of petition signatures, often within a very limited time frame, in order to earn a place on the general election ballot.
When ballot access restrictions are challenged in court it is often argued that such regulations are necessary in order to prevent "frivolous" candidates from cluttering the ballot and confusing voters.

Ballot access rules regulate the conditions under which a candidate or political party is entitled to appear on voters' ballots.
Historically, there were generally no restrictions on ballot access in the United States until after the introduction of the so-called " Australian ballot " beginning in the 1880's.
Proponents of more open ballot access argue that restricting access to the ballot has the effect of unjustly restricting the choices available to the voters and typically disadvantages third party candidates and other candidates who are not affiliated with the established parties.

Also, in 1982, when Alabama increased the number of signatures for new party ballot access from no petition, to a 1% petition, the U.S. Justice Department told the state on July 19, 1982 that the new law couldn't be implemented for the 1982 election.
The new number of signatures may also be subject to a court challenge on the basis of the Supreme Court's term limits decision last year.
SB 330, which greatly improves ballot access for third party and independent candidates, passed the State Senate on March 19 by a vote of 31-15.

Ballot access efforts are under way once again, and now is the crucial time for Libertarians to be lobbying for better ballot access laws in their states.
According to Kris Williams, who heads up the ballot access efforts for the national party, two paid petitioners are working to gather signatures in North Carolina with the hope of keeping the state from decertifying the LP.
Now also is the time for LP members to approach their state legislators encouraging them to introduce new legislation for easing ballot access restrictions.

The ballot access laws for new and minor parties to get on the ballot for Congress are so tough, that not since 1920 has any third party been able to place candidates for the U.S. House of Representatives on the ballot in even half of the districts!
However, at least ballot access in those countries is equitable and fairly tolerant.
Ballot access rules are the same for all parties in Great Britain and Canada.

The Libertarian Party is assured ballot status for 1996 in "22 states, which is a record for us," said Richard Winger, nationally recognized ballot access expert and editor of Ballot Access News.
In New York, although LP gubernatorial candidate Bob Schulz did not get the 50,000 votes needed to achieve ballot status for the LP, the lawsuit that Schulz filed prior to the election was successful in overturning certain petitioning requirements.
The ballot access victories this year put the LP in an excellent position for 1996.

New Hampshire (1) : HB 449, which converts the general election ballot format from party-circle, to office-group, was signed into law on June 8.
New Hampshire (2) : HB 531, which would have made it illegal for a political party to nominate someone who was also the nominee of another party, was vetoed by Governor Stephen Merrill on June 8.
New Jersey : AB 1309, which would move the 1996 primary for all office from June to March, still has not been brought up in the Senate, and passage is considered unlikely.

The Libertarian Party came out of the 1996 elections in the best ballot access shape ever after a presidential election.
The party is on the ballot in 22 states, as opposed to 18 four years ago, and the party is qualified in Pennsylvania -- voters can register Libertarian -- but the LP will still have to petition to get candidates on the ballot.
West Virginia is difficult because the state law is set up to make it virtually impossible to get the gubernatorial candidate on the ballot, and a party needs a candidate in that race in order to qualify.
