But a ruling by Judge Leo Strine left open the possibility for the Barclays to buy the Daily Telegraph, Britain's best selling broadsheet papar, as long as it is done through the board of Hollinger International rather than Black.
Black, who renounced his Canadian citizenship in 2001 to become a British peer, testified last week that Hollinger board members were on a vendetta against him and that he was reluctantly seeking a sale because of the precarious financial and legal position of the group.

The libel action targets the newspaper, its editor Robert Thomson, and its media editor Dan Sabbagh, and hinges on an article published late last year which stated that the Barclay twins had made their fortune buying and selling assets.
According to the legal team representing the Telegraph owners in France, where libel is considered a criminal act, the action was brought when The Times did not respond to a "droit de rèponse" following publication of the article.
