In their response the Barkleys said jailing any of them for non-payment of a civil fine "smacks of debtors prison" and could be a "death sentence" for Barkley's wife, Shirley, who is suffering from diabetes and chronic heart disease.
The Barkleys appealed May's order to the Charlevoix circuit court, where Pajtas ruled in favor of the township but said that because of their declarations of poverty, none of the Barkleys could be jailed for failing to remove the structures or to pay assessments or fines.

BAY TOWNSHIP: Trailers must be removed   (Site not responding. Last check: 2007-11-05)
Judge Richard Pajtas affirmed this week a district court ruling that Lyle Barkley, wife Shirley and daughter Kimberly violated township zoning and county building codes by grafting two trailers onto existing trailers and adding a portable after receiving township permits in 2002 to build additions.
The case received national attention when Barkley, supported by some militia groups, last year vowed to meet with armed force any attempts to remove the structures from his property.
In his decision this week, Pajtas rejected the Barkleys' claims that Bay Township has no authority to enact zoning and that they were improperly denied a jury trial.

THE BARKLEYS OF BROADWAY is the story of a husband-and-wife musical comedy team who bicker incessantly and eventually break up because the wife (Dinah) wants to prove to herself and her husband (Josh) that she is a capable dramatic actress and not just a song-and-dance girl.
BARKLEYS isn't really a fun picture in the way the early RKO films were however, because it just isn't written that way.

The Barkleys then brought what Pajtas said was a new suit challenging the authority of the district court to act in the case because then township zoning administrator Randy Frykberg, county building official Ken Doty and assistant prosecutor Brian Seelye had allegedly failed to take their oaths of office as required by state law.
The Barkleys argued because the officials were not properly invested with their offices they lacked authority to issue citations or prosecute the case.
Pajtas acknowledged that the Barkleys had mislabeled their motion as an appeal, which it was not, he said, because May had failed to rule on the issue of oath-taking.

But though both had their victories elsewhere, the two will always be remembered best for their work together, and Barkleys is not only notable for it being their last collaboration, but their first and only outing in color.
Written by Betty Comden and Adolph Green, the film (like their later effort, 1953's The Band Wagon) draws inspiration from real life: Astaire and Rogers play Josh and Dinah Barkley, a couple who've been together for years, although the seams of their marriage are showing.
Like most of their films together, the plot of The Barkleys of Broadway is a trifle that allows for numerous song-and-dance numbers, with the standout being Astaire's reprisal of "They Can't Take that Away from Me" (from Shall We Dance).

Barkleys' biggest assets, of course, are the stars themselves, who have lost none of their luster or, more importantly, their chemistry despite the ten years separating Barkleys from their earlier classics.
