Navy's Gridley is christened at Bath Iron Works - Boston.com
BATH, Maine --When she was 10 years old, Cathy Forst watched her mother christen the third USS Gridley with champagne as hundreds of spectators cheered.
For workers at Bath Iron Works, the shipyard is entering an uncertain period as the shipyard moves from construction of Arleigh Burke-class destroyers like the Gridley to the next-generation DD(X) destroyer that's larger and more expensive.
Bath Iron Works has reduced its work force from 12,000 in the 1980s to 5,600 now, and further cuts are expected even under the most optimistic scenarios.

Having built its first passenger steamer in 1890, Bath Iron Works (BIW) is one of the oldest and most highly-regarded shipyards in the United States.
Built in 1884 and located in the same town in Maine that shares its name, Bath Iron Works is located on the pretty Kennebec River, not far from the city of Portland.
Because Bath Iron Works has been in business for so long and has employed so many individuals, the potential for exposure to asbestos at this Maine shipyard is great.

Bath Iron Works v. Director, OWCP (1st Cir. 2001)
BIW argued, however, that the earlier ALJ decision conclusively established that Hutchins was last exposed to toxins during Birmingham's period of coverage.
BIW maintains that, because no new injury was alleged, the only question before the ALJ was whether the earlier award should be modified upward to compensate Hutchins for the change in his condition to total disability.
BIW argues (1) that the company was unfairly ambushed by the unexpected scope of the proceedings, (2) that the ALJ lacked authority to re-allocate responsibility, and (3) that the ALJ applied an incorrect legal standard in determining liability.

BIW asserts that the Navy failed to conduct the competition on a common basis when it denied the Blue Team the use of a decommissioned DD 963-Class destroyer for at-sea testing while at the same time accepting for purposes of the evaluation the Gold Team's proposed use of a decommissioned DD 963-Class destroyer.
BIW asserts that the source selection decision failed to account for the development risk associated with the Gold Team's approach by not considering that there was a [DELETED] likelihood that the development of the peripheral VLS would be abandoned and that the Gold Team instead would rely on its fallback unitary VLS.

Accordingly, unlike fraud or deceit, the defendant's knowledge is largely immaterial for negligent misrepresentation, and the fact-finder's primary task is to ascertain whether the defendant's conduct was reasonable.
