 Intro to Trademarks Kelly
Therefore, the mark must be one which can be used by a supplier, to identify its own goods or services, without interfering with the rights of other suppliers to sell similar products under their own different trademarks.
If and when the examiner is satisfied that a proposed mark is registerable, that fact is noted on the PTO database, and the mark is also published in a weekly journal called the Trademark Gazette, which is published by the U.S. Patent and Trademark Office.
While a mark is in force, the major legal action that needs to be taken by the owner occurs during the sixth year, when a "Section 8" affidavit must be submitted stating that the trademark is still in use.
